This criminal appeal under Section 14-A of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 (hereinafter to be referred as 'the SC/ST Act’) has been filed on behalf of the appellant being aggrieved with the order dated 23.04.2024 passed by the learned Special Judge SC/ST (Prevention of Atrocities) Cases, Jaipur District Jaipur-cumAdditional Sessions Judge No.2, Jaipur District Jaipur (hereinafter to be referred as ‘trial Court’) in Bail Application No.124/2024, whereby the bail application filed on behalf of the appellant in connection with FIR No.19/2024 registered at Police Station Dudu, District Dudu for offences under Sections 420, 406, 341, 323 & 504 IPC and Sections 3(1)(r), 3(1)(s) & 3(2)(va) was rejected.

Learned counsel for the appellant submits that the Police after conclusion of investigation has submitted charge-sheet against the appellant only for offences under Sections 420, 406, 467, 468 and 471 IPC before the learned Judicial Magistrate, Dudu.

Initially the case was registered for offences under Sections 420, 406, 341, 323 & 504 IPC and Sections 3(1)(r), 3(1)(s) & 3(2) (va) of the SC/ST Act. After rejection of bail, this appeal under Section 14-A of the SC/ST (Prevention of Atrocities) Act has been filed. Since no charge-sheet has been filed for offence under the provisions of SC/ST Act against the petitioner and now the further proceedings in criminal case will proceed in a normal procedure under the provisions of Code of Criminal Procedure.

In such circumstances, when no charge-sheet for offence under the provisions of SC/ST Act has been filed against the appellant, learned counsel for the appellant seeks to withdraw this appeal with liberty to avail appropriate legal remedy for seeking bail in change circumstances before the appropriate Court.

In view of the above, the present appeal is disposed of as withdrawn with liberty to the appellant to avail appropriate legal remedy for seeking bail before the appropriate Court.
