This application for bail has been filed by the petitioner under Section 439 of Cr. P.C. in connection with FIR No.180/2022, Police Station, Sri Karanpur, District Sri Ganganagar for the offences under Sections 376, 376(2)(N) IPC
Petitioner’s uncle appearing in person submits that petitioner is innocent person and he has been falsely implicated in this case. He is behind bars since 21.01.2022. Charge-sheet has already been filed.
Perused the material available on record.
This Court has perused the statement of prosecutrix recorded under Section 164 Cr. P.C. wherein she states that the

petitioner used to come to her house on various occasions. On one occasion, when she had gone to dump waste material, at that time, the petitioner came and forcibly took her to varanda of house and committed rape on her.
Learned PP vehemently opposes the application.
Mr. Vikky Nagpal, I.O. present in person submits that the allegation in regards to uploading/ making the photographs and video viral has been investigated upon by him and it was found that the images in the video-clips were not of the complainant.
The complainant present in person submits that he does not wish to submit anything before this Court.
Having regard to the facts and circumstances of the case and without expressing any opinion on merits/demerits of the case, this Court is of the opinion that the bail application filed by the petitioner deserves to be accepted.
Consequently, the bail application filed under Section 439 Cr.P.C. is allowed. It is ordered that petitioner Ram Singh @ Rama S/o Balwant Singh shall be released on bail in connection with the aforesaid FIR; provided the petitioner executes personal bond in the sum of Rs.50,000/- and two sureties of Rs.25,000/each to the satisfaction of the learned trial Court. Petitioner shall be required to appear before that Court on all dates of hearing and as and when called upon to do so.
