This application for bail has been filed by the petitioner under Section 439 of Cr.P.C. in connection with FIR No.383/2022, Police Station Kotegate, District Bikaner for the offences U/s. 307, 120-B IPC and Section 3/25 of Arms Act.

Perused the material available on record.

Petitioner’s uncle appearing in-person submits that the petitioner has been falsely implicated. The main accused Pawan had fired upon the complainant and the petitioner has no role to play in the incident. He further submits that the petitioner is behind bars and the trial of case is likely to take a long time, therefore, bail may be granted.

Learned PP vehemently opposes the application and submits that charge-sheet has already been filed.

Having regard to the facts and circumstances of the case and without expressing any opinion on merits/demerits of the case, this Court is of the opinion that the bail application filed by the petitioner deserves to be accepted.

Consequently, the bail application filed under Section 439 Cr.P.C. is allowed. It is ordered that petitioner Raja Ram S/o Shri Ramswaroop shall be released on bail in connection with the aforesaid FIR; provided the petitioner executes personal bond in the sum of Rs.50,000/- and two sureties of Rs.25,000/- each to the satisfaction of the learned trial Court. Petitioner shall be required to appear before that Court on all dates of hearing and as and when called upon to do so.
