This application for bail has been filed by the petitioner under Section 439 of Cr. P.C. in connection with FIR No.577/2022, Police Station, Kotwali Bhilwara, District Bhilwara for the offences under Sections 376, 384, 420, 341, 323 & 120-B IPC

Petitioner’s Bhabhi appearing in person submits that petitioner is innocent person and he has been falsely implicated in this case. He is behind bars since 25.12.2022. Charge-sheet has already been filed.

Perused the material available on record.

Upon perusal of statement of prosecutrix recorded under Section 164 Cr. P.C., it reveals that she stated that she and the petitioner were working in the same Company and petitioner repeatedly used to commit rape upon her, however, there is no

satisfactory explanation by the complainant for not opposing the same.

Learned PP vehemently opposes the application.

Having regard to the facts and circumstances of the case and without expressing any opinion on merits/demerits of the case, this Court is of the opinion that the bail application filed by the petitioner deserves to be accepted.

Consequently, the bail application filed under Section 439 Cr.P.C. is allowed. It is ordered that petitioner Akhil S/o Moti Singh shall be released on bail in connection with the aforesaid FIR; provided the petitioner executes personal bond in the sum of Rs.50,000/- and two sureties of Rs.25,000/- each to the satisfaction of the learned trial Court. Petitioner shall be required to appear before that Court on all dates of hearing and as and when called upon to do so.
