This Criminal Misc. Bail Application has been brought under Section 439 of Cr.P.C. seeking regular bail in connection with F.I.R. No. 283/2020 registered with Police Station Bhiwadi District Alwar, for the offence/s punishable under Section/s 377, 392, 323, 365, 342, 328 and 120B of I.P.C.

It has been submitted on behalf of the accused petitioner that co-accused Munfed @ Munfad @ Kala has been released on bail on 30.9.2020, by a Co-ordinate Bench of this Court. Main allegation was against the co-accused petitioner Munfed @ Munfad @ Kala. Present petitioner has been roped in with the help of Section 120B of IPC. Charge-sheet has been filed. Completion of trial will take time.

Learned Public Prosecutor has opposed the bail application.

Heard learned counsel for the petitioner/s as well as learned Public Prosecutor, perused the material available on record and the case diary.

On consideration of the arguments/submissions of both the parties, perusal of material on record, looking to the overall facts and circumstances of the case, and nature of offence/s, but without commenting upon detailed merits of the case, this court deems just and proper to enlarge the accused petitioner on bail.

Accordingly, the bail application is allowed. Accused petitioner Rakesh Meena S/o Chhitrapal Meena be released on bail in FIR No. 283/2020 registered with Police Station Bhiwadi District Alwar , if he is not wanted in any other case, provided he furnishes a personal bond in the sum of ₹ 50,000/- (fifty thousand) together with two sureties in the sum of ₹ 25,000/(twenty-five thousand) each to the satisfaction of learned trial court with the stipulation that he shall appear before that court or any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
