This Criminal Misc. Bail Application has been brought under Section 439 of Cr.P.C., seeking regular bail in connection with FIR No.70/2020 registered at Police Station Sapotra District Karauli for offence under Sections 379, 420 of IPC and 66 of I.T. Act.

It has been submitted on behalf of the petitioner that he has been falsely implicated in this case. No offence under Sections 379, 420 of IPC and Sections 66C and 66D of I.T. Act is made out on the basis of evidence available on record. Complainant and accused-petitioner have entered into a compromise.

Learned counsel present on behalf of the complainant also submits that compromise has been entered into by both the parties. No dispute is pending. The matter is between father and son. Completion of trial will take time.

Learned Public Prosecutor and learned counsel for the complainant have opposed the bail application.

On consideration of arguments/submissions of both the parties, material on record and overall facts and circumstances of the case, but without commenting upon detailed merits of the case, this Court deems it fit to enlarge the accused on bail.

Therefore, the bail application is allowed. Accused-petitioner Ramlakhan @ Pappu S/o Motilal shall be released on bail in FIR No.70/2020 registered at Police Station Sapotra District Karauli, if he is not wanted in any other case, provided he furnishes a personal bond in the sum of Rs.1,00,000/- (One Lakh) together with two sureties in the sum of Rs.50,000/- (Fifty Thousand) each to the satisfaction of learned trial court with the stipulation that he shall appear before that Court or any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
