This Criminal Misc. Bail Application has been brought under Section 439 of Cr.P.C., seeking regular bail in connection with FIR No.32/2020 registered at Police Station Chouth Ka Barwara, District Sawai Madhopur for offences under Section 379 of IPC.

It has been argued on behalf of the petitioners that this is a case of false implication. There is no evidence against them on record. All other criminal cases shown as pending against them have been lodged in the same Police Station in a continuous sequence bearing FIR Nos.28/2020, 29/2020, 30/2020 and 31/2020. Challan has been filed. Completion of trial will take time.

Learned Public Prosecutor has opposed the bail application.

On consideration submissions made by both the parties and perusal of material available on record and taking into consideration the submissions put forth and overall facts and circumstances of the case, but without commenting upon detailed merits of the case, this Court deems it fit to enlarge the accused on bail.

Therefore, the bail application is allowed. Accusedpetitioners Heeralal S/o Ramdev and Devendra @ Sagar S/o Hargovind , shall be released on bail in FIR No.32/2020 registered at Police Station Chouth Ka Barwara, District Sawai Madhopur for offences, if they are not wanted in any other case, provided each of them furnishes a personal bond in the sum of Rs.50,000/- (Fifty Thousand) together with two sureties in the sum of Rs.25,000/(Twenty-five Thousand) each to the satisfaction of the learned trial court with the stipulation that they shall appear before that Court or any court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
