Petitioner has filed this Vth petition under Section 439 Code of Criminal Procedure, 1973 seeking regular bail in FIR No. 0206/2018 registered at Police Station Malarana Doonger, District Sawai Madhopur for offence under Section 420 & 406 Indian Penal Code, 1860.

“Petitioner has filed this petition under Section 439 Code of Criminal Procedure, 1973 seeking interim bail in F.I.R. No. 0206/2018 registered at Police Station Malarana Doonder, Distt. Sawai Madhopur, for offences under Sections 420, 406 of Indian Penal Code, 1860.

Learned counsel for the petitioner has submitted that the petitioner be granted interim bail for fifteen days to enable him to make the payment of the amount-in-question to the complainant.

The submissions made by the learned counsel for the petitioner have not been opposed by the counsel for the complainant.

Accordingly, petitioner be released on interim bail subject to satisfaction of the trial Court.

List again on 17.12.2018.”

Learned counsel for the complainant has submitted that the petitioner after his release on interim bail has failed to make the payment of amount-in-question to the complainant and has rather threatened the complainant of dire consequences. Learned counsel has submitted that the petitioner has cheated the complainant. Petitioner purchased a truck from the complainant in the sum of Rupees fourteen lacs. The cheques issued by the petitioner in favour of the complainant towards consideration amount, were dishonoured by the bank when they were presented for encashment. The truck was however, got registered in the name of the petitioner. Petitioner obtained loan from the finance company by hypothecating the truck. Petitioner has failed to repay the loan installments to the finance company.

Keeping in view the facts and circumstances of the case, no ground for grant of bail to the petitioner is made out.

Dismissed.

Petitioner is directed to surrender before the trial court on 18.12.2018 at 10.00 a.m. failing which the trial court shall order the arrest of the petitioner through arrest warrants.
