Appellant has filed this appeal under Section 14-A of The Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 seeking regular bail in F.I.R. No. 345/2018 registered at Police Station Kotkasim, District Alwar for offence under Sections 332, 353 of Indian Penal Code, 1860 and Section 3(1)(m)(n)(2) (V-a) of The Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

On 15.11.2018 following order was passed by this court:-

“Learned counsel for the appellant has

submitted that the complainant is a Sarpanch of the village. The meeting-in-question was attended by seven Panchs and all the said Panchs have given affidavits that no occurrence as alleged had taken place. Infact, the Panchs had boycotted the metting as the same was not being conducted by the Sarpanch as per rules.

List again on 13.12.2018. In the meantime, in the event of arrest, appellant be released on interim bail subject to the satisfaction of the Arresting Officer. Appellant shall abide by the conditions envisaged under Section 438(2) Cr.P.C."

Learned State counsel has submitted that in pursuance to the above order, appellant has joined investigation.

Accordingly, keeping in view the facts and circumstances of the case and the fact that the appellant has joined investigation, without expressing any opinion on merits of the case, interim bail granted by this Court to the appellant vide order dated 15.11.2018 is made absolute.

Appeal stands disposed of accordingly.
