Heard learned Public Prosecutor and the learned counsel for the respondents and perused the judgment impugned.
This Court is of the opinion that there are valid and substantial grounds for grant of leave to the Union of India for filing an appeal against the acquittal of the respondents vide impugned judgment.
Accordingly, the application for grant of leave to appeal is allowed. The memo of leave to appeal be treated as an appeal and it be registered as such.
The respondent shall be kept present to furnish a personal bond in the sum of Rs. 30,000/- and one surety in the like amount to the satisfaction of Dy. Registrar (Judl.) Rajasthan High Court, Jodhpur on or before 20.9.2017 for ensuring his presence before this Court as and when required.
