र९ाथ� की ओर से यह दािण्डक िविवध यािचका धारा 482 दण्ड र९िरढ़या संिहता के अन्तगर्त र९स्तुत की गयी है, िजसके �ारा न्याियक मिजस्रय़ेट, ल�मणगढ़ �ारा पािरत आदेश िदनांक 17.4.2008 को चुनौती दी गयी है।
र९करण को सुनवाई हेतु िलये जाने पर र९ाथ� की ओर से पैरवी हेतु कोई उपिस्थत नह� है।
मैन� िव�ान लोक अिभयोजक को सुना। आ्षेिपत आदेश एवं पर७ावली पर उपलब्ध सामरय़ी का ध्यानपूवर्क अवलोकन िकया।
म� र९ाथ� की ओर से र९स्तुत इस यािचका म� कोई बल नह� पाता हूं। अत: र९ाथ� की ओर से र९स्तुत यह दािण्डक िविवध यािचका अन्तगर्त धारा 482 दण्ड र९िरढ़या संिहता िनरस्त की जाती है। िफर भी आवश्यक होने पर र९ाथ� को पुन: यािचका र९स्तुत करने की स्वतंर७ता र९दान की जाती है। यािचका के साथ संल्ि स्थगन र९ाथर्नापर७ भी िनरस्त िकया जाता है।
