Prayer in this 1st petition file d under Section 439 Cr.P.C., is for grant o f regular bail to the petition e rs in case FIR No. 87 dated 27.10.202 0 registered under Section 4 of t he Protection of Women from Domestic Violence Act, 2005 and Sec t ion 67-B of the Information Technolog y Act, 2008 (Section 6 of the P O CSO Act and Section 201 IPC added late r on and Section 4 of the POC S O Act and Section 67-B of the IT Act del e ted) at Women Police Station P a nchkula, District Panchkula. Learned counsel for the Sta t e has filed custody certificate dated 09.0 9 .2024 of the petitioner which i s taken on record, as per which the petitio n er has been in custody as an un d ertrial for a period of 03 years, 10 months and 11 days.
After arguing for some time, when this Court is not inclined to accord the benefit of regular bail to t he petitioner, learned counsel submits th a t he may be permitted to with d raw the instant petition, at this stage.
Permitted to do so.
