Counsel for the petitioners states that the present petition can be disposed of by giving direction to the respondents to consider and decide the legal notice dated 22.02.2013 (Annexure P-8) served by the petitioners on the Director Public Instructions (S.E.), Punjabrespondent No.2 within some specified time as the claim of the petitioners is based upon the judgment passed by this Court in CWP No. 2208 of 1989 titled as Lekh Raj Khera and others vs. State of Punjab and another , decided on 24.3.2009 (Annexure P-6). This prayer of the counsel for the petitioners could not be opposed by the counsel for the respondents.

In view of the above, present writ petition is disposed of with directions to the Director Public Instructions (S.E.), Punjab-

respondent No.2 to consider and decide the legal notice served by the petitioners dated 22.02.2013 (Annexure P-8) within a period of four months from the date of receipt of certified copy of the order. Decision so taken be conveyed to the petitioners forthwith.

In case the claim of the petitioners is accepted, the consequential benefits be released to the petitioners in accordance with law within a further period of two months. Arrears, if any, shall be restricted to 38 months prior to the date of submission of the representation. In case the claim of the petitioners as projected by them in their representation is not to be accepted a well reasoned and speaking order be passed and conveyed to them forthwith.
