Brief allegations against the petitioner-accused are that complainant is a widow, aged about 45 years, having four children. Her husband had expired about one year ago. Petitioner-accused was on visiting terms to her house. About 4-5 months before 17.03.2013 when this report was lodged, she was all alone in her house as her children had gone the village to play, petitioner-accused entered her house and had taken her inside the house on he pretext that he wanted to talk to her. She followed her and thereafter he raised a threat to her and finding her alone, forcibly committed rape upon her. Thereafter, he threatened her that if she would tell about the incident to anybody, he would kill her and her children. Hence, she did not disclose the incident to anyone. He had been continuing to commit rape under the garb of that threat. She became pregnant. She was going to commit suicide and however, Panch of village Sugna Bai intervened and she narrated all the facts to her and thereafter lodged the complaint with the police. She also gave statement under Section 164 Cr.P.C. before the Magistrate narrating all the facts.
