The decision rendered by the Hon'ble Supreme Court in
State of Punjab Vs. Tehal Singh & others (Civil Appeal No.5826
of 1999, decided on 7.1.2002 , apparently would cover the challenge raised in the present petition. Counsel appearing for the petitioners did make an attempt to show that there are some other issues involved, but in my view at this stage and in view of the said judgment of the Hon'ble Supreme Court, there would not be much need to go into the issues raised in the writ petition.
In view of the order passed by the Hon'ble Supreme Court in Tehal Singh's case(supra) , the writ petition is dismissed. Otherwise also the writ petition is dismissed as having become infructuous.
