RANJIT SINGH, J.
While issuing notice in this case, this court had noticed as
under:-
“The earlier prayer for bail of the petitioner was rejected on 24.1.2012. Now the statement of one witness from the Army has been recorded. Counsel says that the enquiry held by Army is neither part of challan nor has been led in evidence. Counsel further contends that kneaded wheat flour and Rajmah, which were taken in possession after three months, have gone in a contaminated condition because of passage of time. Accordingly, prays that prayer for bail of the petitioner may require consideration.” There is some substance in the submissions as noted above. The petitioner otherwise is a wife and is in custody from May, 2011 onwards. The plea that the entire story has been concocted to grab the benefits due to the family of deceased cannot be discounted altogether.
Without any comments on merits, bail to the satisfaction of CJM/Duty Magistrate, Gurdaspur.
Petition is allowed.
