Jaspal Kaur , the petitioner has sought regular bail in a case registered by way of FIR No. 73 dated 9.7.2010 at Police Station Longowal, District Sangrur for an offence punishable under sections 498-A, 304-B read with section 34 IPC.

Learned counsel for the petitioner submits that Satbir Kaur deceased was married with the son of the petitioner namely Sukhchain Singh @ Sonu three years prior to her death. According to him, allegations are there against the husband by name and in an omnibus manner against others. According to him, there are no specific allegations against the petitioner of having demanded any dowry. He further submits that the petitioner is in custody since 23.7.2010. According to him, the other accused who were similarly placed namely Joginder Singh and Amandeep Kaur have been granted the concession of bail by this court vide orders dated 12.7.2011 and 11.2.2011 respectively. petitioner further submits that Satbir Kaur died due to poisoning of choloro compound insecticide and there was no injury on her person as per post-mortem examination.

Learned State counsel, on the other hand, admits that no injury was found by the doctors, who had conducted post-mortem examination, on the body of the deceased.

It is a case where death was due to poisoning. Looking to the fact that the allegations against the petitioner and two others namely Joginder Singh and Amandeep Kaur who have already been granted bail in this case are similar, I also find the petitioner to be entitled to bail. Consequently, the petition is allowed and the petitioner is ordered to be released on bail on her furnishing a personal bond in a sum of Rs.25,000/- with one surety in the like amount to the satisfaction of learned trial court.
