(1). The cause of these contempt proceedings is the alleged noncompliance of the orders passed by Tribunal as well as this Court in terms whereof, the arrears of salary and benefit of pay fixation were to be granted to the petitioner.

Respondents No.2 & 3 along with their short-affidavit dated 13.12.2011 have appended Annexure ‘J’ which is a calculation-sheet in order to contend that the due amount has been paid to the petitioner. Their claim, however, has been disputed by the petitioner who has also filed an affidavit dated 07.03.2012 to the effect that he explained the Principal that there is an arithmetical mistake in the calculation sheet and an additional sum of Rs.2,65,500/- is payable to him.

Learned counsel for respondents No.2&3 states that the College is governed under the Grant-in-Aid Scheme and the revised/additional claim put forth by the petitioner has been forwarded to the DPI Colleges, Government of Punjab for verification/release of Grant and no sooner the approval is granted, the due amount, to the extent of approval, shall be released to the petitioner.

In view of the above-stated stand taken on behalf of the respondent-Management, I deem it appropriate to dispose of these proceedings with a clarificatory direction to the DPI Colleges, Punjab to verify the petitioner’s entitlement for the additional claim referred to above. The petitioner may prepare and submit his calculation sheet to the Principal of the College as well as the DPI (Colleges) Punjab who shall re-verify his claim and in case found entitled to, the due amount shall be released within four months from the date of submission of claim by the petitioner.
