Vide order dated 18.9.2009, the claim of the petitioners was kept pending observing that the same “will be considered only after the final decision of the Hon'ble Apex Court as explained above....”. The petitioner has placed on record an order dated 23.9.2011 (Annexure A-1) passed by the Hon'ble Supreme Court, whereby the Special Leave Petition has been disposed of with the following directions:-

“(i) the directions given by the High Court for consideration of the cases of the writ petitioners for promotion to the post of Headmaster, High School is confirmed;

(ii) the omnibus direction was given by the High Court for consideration of the cases of all other Sanskrit Teachers working in the department, who possess qualification equivalent to B.T., B.Ed. and have the requisite experience for promotion to the post of Headmaster, High School is set-aside.

However, it is made clear that this order shall not preclude other persons claiming to be eligible for promotion to the post of Headmaster, High School to seek appropriate remedy.....”

In this view of the matter, it is obligated upon the respondents to re-consider the claim of the petitioner in the light of the above reproduced directions issued by the Hon'ble Supreme Court.

Let the needful shall be done within a period of three months from the date of receiving a certified copy of this order and the consequential benefits be released within the above-stated period, failing which the petitioner shall be entitled to seek revival of these proceedings.

Ordered accordingly.
