The petitioner, now represented by his legal heir, alleges noncompliance of the order dated 31.10.2006 passed by this Court in CWP No.16561 of 2006 whereby his representation for re-imbursement of the expenses incurred on his bye-pass heart surgery was directed to be decided in a time bound manner.

The reply-affidavit filed by Sada Ram, Assistant General Manager/Assistant Secretary, Haryana State Cooperative Agriculture and Rural Development Bank Ltd. hardly touches upon the merits of the petitioner's claim. The reply-affidavit is merely to the effect that the said respondent stood transferred and has not committed any contempt of Court.

Keeping in view the nature of relief sought, pendency of this contempt petition would not yield any effective relief to the petitioner. As noticed above, the only reply on record does not indicate as to whether the due amount of medical re-imbursement has been paid to the petitioner or not? In these circumstances, I deem it appropriate to dispose of this contempt petition with a clarificatory direction to the present Managing Director of the Haryana State Cooperative Agricultural and Rural Development Bank Limited, to consider the entire claim for medical reimbursement of the deceased-Ram Sharan who was a Land Valuation Officer in the Bank and dispose of the same by passing a reasoned order within a period of three months from the date of receiving a certified copy

of this order. In case it is found that the deceased-employee was entitled to any re-imbursement, the same shall be released to his legal heirs alongwith interest @ 7% per annum. In the event of finding that the deceased was not entitled to any payment, a speaking order be passed within the aforementioned stipulated period.

Ordered accordingly.

Rule discharged.
