The petitioner has approached this Court by way of instant petition filed under Articles 226/227 of the Constitution of India praying for issuance of a writ in the nature of mandamus directing the respondents to consider his case for deemed promotion as JE-2, JE-1 and again as AE from the due dates and grant consequential benefits of pay/seniority etc. from the dates when his juniors (respondents No.5 and 6) were promoted, besides allowing 18 years proficiency increment and benefits under the ACP Scheme and 23 years promotion scale and to pay arrears of salary due to him along with interest.
Learned counsel for the petitioner submits that the petitioner has sent a legal notice dated 13.3.2010 (Annexure P-9) to the respondents for the same relief as claimed in this writ petition but no action has been taken thereon so far and he shall feel satisfied if a direction is issued to them to decide the same in a given time frame.
After hearing the learned counsel for the petitioner and perusing the file, the present writ petition is disposed of with a direction to the concerned respondent to take a decision on the legal notice (Annexure P-9) sent by the petitioner within a period of three months from the date of receipt of a certified copy of this order by passing a speaking order and after affording an opportunity of hearing to him.
