Sh. Manjit Singh son of the petitioner, who was working as Peon in the Punjab Small Industries & Export Corporation, Chandigarh, was a divorcee having two minor children. He expired on 3.5.2008. It is the case of the petitioner that since two minor children of the deceased employee are living under his guardianship, therefore, he is entitled for the service benefits of the deceased employee on behalf of two minor children of the deceased employee, which have not been paid by the the respondents till date.

It is further the case of the petitioner that in this regard a legal notice dated 17.4.2009 has been served upon the

respondents, which is annexed as Annexure P-8, but till date neither the same has been considered nor the service benefits of the deceased employee have been released to his legal heirs in accordance with law.

In view of these facts, without issuing notice to the other side as it will unnecessary delay the matter, this petition is disposed of with a direction to respondent No.1 to consider and decide the said legal notice (Annexure P-8) filed by the petitioner for the grant of said benefit, expeditiously, preferably within a period of three months in accordance with law. In case the petitioner and two minor children of the deceased employee are found entitled for the release of retiral benefits of the deceased, the same be released immediately.
