The petitioner, who voluntarily retired from the service of Housing Board, Rewari, on 29.02.2008, has filed the instant petition for issuing direction to the respondents to release his retiral benefits i.e. pension, gratuity, leave encashment and provident fund etc.
In the written statement filed on behalf of respondents, it has been stated that except the pension, other retiral benefits i.e. gratuity, leave encashment etc. have been paid to the petitioner. As

far as the pension is concerned, it has been stated that no pension is payable to the retired employees of the Housing Board. This fact has not been controverted by the counsel for the petitioner.
In the replication filed by the petitioner, it has been stated that the benefit of 6th Pay commission has not been given to the petitioner.
In this regard, counsel for respondent Nos.2 to 4 states that as far as the 6th Pay Commission benefits are concerned, the same have not been notified till date by the respondent-Corporation, and as and when the said notification is issued, the benefit of the same will also be given to the petitioner.
In view of the said statement made by counsel for respondent Nos.2 to 4 , learned counsel for the petitioner does not want to press this petition.
Dismissed as not pressed.
