Navtej Singh and Others Vs State of Haryana and Another

The prayer made in the instant petition is for issuance of directions to the Land Acquisition Collector-cum- Sub Divisional Officer (Civil), Ambala-respondent No.2 to make a reference dated 27.5.2002 (Annexure P-1) filed by the petitioners, under Section 18 of the Land Acquisition Act, 1894 (for brevity, 'the Act). The reference under Section 18 of the Act has been duly received by the Land Acquisition Court on 3.6.2002 for determining and enhancing the market value of the acquired land.

The land of the petitioners stands acquired after issuance of notifications under Section 4 and 6 of the Act on 10.9.2001 and 4.1.2002 respectively by invoking urgency provision. Award was

announced on 26.4.2002 being Award No.14. Thereafter, the petitioners have filed reference under Section 18 of the Act for enhancement of compensation.

Notice of motion has been issued. Learned State counsel has put in appearance on behalf of the respondents.

Looking at the nature of the controversy raised, we deem it just and appropriate to direct the Land Acquisition Collector-cumSub Divisional Officer (Civil), Ambala-respondent No.2 to send the reference dated 27.5.2002 (Annexure P-1), filed by the petitioners to the Reference Court expeditiously, preferably within a period of three weeks from the date of receipt of a certified copy of this order.
