The petitioners are apprehending their arrest in
Patna High Court CR. MISC. No.22614 of 2020(6) dt.22-11-2021 2/2
connection with Sasaram (M) P.S. Case No. 364 of 2019 for the offence registered under Sections 147, 148, 149, 323 and 307 of the Indian Penal Code and Sections 25 (1-b)a, 26 and 27 of the Arms Act.
Learned counsel for the petitioners submits that the petitioners have falsely been implicated in the present case due to prior enmity. It is further submitted that no incriminating articles have been recovered from possession of the petitioners and there is no specific overt act against the petitioners. It is further submitted that no one sustained injury in the occurrence.
Considering the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest/surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sasaram, Rohtas in connection with Sasaram (M) P.S. Case No. 364 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
