This application, for grant of anticipatory bail, arises out of C.A. (Complaint Case) No. 746/2016, disclosing offences under Section 498A of the Indian Penal Code.

Earlier the matter was referred to Patna High Court, Mediation and Conciliation Center, Patna and the report of mediator has been received, from which, it appears that the dispute between the parties has been resolved on the terms of settlement mutually agreed upon by them and from the Memorandum of agreement enclosed with the report, it appears that petitioner has agreed to pay Rs. 4,50,000/- to the

complainant in two equal installments of Rs. 2,25,000/-. Thereafter, they would file the divorce case on mutual consent and, thereafter, they would withdraw the cases file against each other and after receipt of Rs. 4,50,000/-.

Having heard the parties, considering the aforementioned facts, Let the petitioner, above named, surrender before the court below on 11.07.2019 and on surrender he will be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Patna City, in connection with C.A. (Complaint Case) No. 746/2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

It is further subject to the condition that both the parties shall abide by the terms and condition mentioned in the memorandum of agreement.

Let a copy of Mediator’s report as well as a copy of Memorandum of agreement be sent to the concerned court below.
