The petitioner is apprehending his arrest in connection with Katihar Sahayak P.S. Case No. 515/2012 pending before Chief Judicial Magistrate, Katihar, for the offences under Sections 147, 148, 149, 452, 341, 307 of the Indian Penal Code and Section 27 of the Arms Act and Section 3/4 of the Explosive Substance Act. In view of petitioner absconding (by not taking any step in earlier instituted inter party case bearing Katihar P.S. Case No. 91/2009 wherein he named accused) thus, in subsequent instant case, petitioner appears not entitled for the privilege sought, accordingly, prayer for anticipatory bail of the petitioner is hereby refused. Further, petitioner is directed to surrender before the court below within a fortnight and seek regular bail where the prayer may be considered on its own merit. Let a copy of this order be communicated to the court below through Fax at the cost of petitioner.
