This is 2^nd attempt on behalf of the petitioner, whose prayer was earlier refused on 25.04.2012 passed in Cr. Misc. No. 13958 of 2012 with a liberty to renew the prayer before the trial court itself after examination of the victim.

It is submitted and evident from the report of the trial court that earlier on two occasions the victim appeared but she could not be examined and, thereafter, for about last two years she has not been turning up. The petitioner undertakes to be physically present on each and every date before the court below on the dates fixed . Further, as submitted, he carries no criminal antecedent.

If it is so, in the event of filing duly verified application by the petitioner supported with personal affidavit before the court below to the effect stated above and the father stood as one of the bailors , the petitioner abovenamed is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 3^rd Adhoc Additional Sessions Judge, Muzaffarpur, in

connection with Sessions Trial No. 74 of 2012 arising out of Katra P.S. Case No. 130 of 2011, subject to condition to remain physically present before the court below on each and every date till disposal of the case, failing which, the privilege granted shall be deemed to be cancelled .
