The informant is victim of the case registered under section 366A of the Penal Code wherein it has been alleged that the petitioner had kidnapped the informant.
Submission is that subsequently the informant has filed a petition before the Chief Judicial Magistrate, Araria and has stated that she has not identified any body. It has also been submitted that though the Dy. Supdt. Of Police has recommended for submission of charge sheet under section 366 of the Penal Code but the Supdt. Of Police found the case to be under section 366A of the Penal Code and charge sheet has been submitted only under section 366A and not under section 366 of the Penal Code.

The petitioner is in custody since 27.7.2013 and he is a man of clean antecedent.
Considering the facts and circumstances of the case, the above named petitioner is directed to be released on bail on furnishing bail bond of rupees ten thousand with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Araria in connection with Jogbani P.S.Case No. 59/2013.
