| 2 | 22-01-2014 Heard learned counsel for the petitioner and learned A.P.P. appearing for the State. The petitioner is languishing in custody since 03.06.2013 in a case registered for the offences punishable under sections 25(1-B)A and 26 of the Arms Act. It is alleged that from the hutment of the petitioner one country made pistol and live cartridge were recovered. During investigation of a case under section 395 of the Indian Penal Code from the possession of the petitioner the aforesaid arms were recovered. |
It is submitted by the learned counsel for the petitioner that the recovery is not from conscious possession of the petitioner.

Considering the aforesaid facts, let the above named petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Aurangabad in connection with Salaiya P.S. Case No. 26 of 2013.
The learned court below will be at liberty to cancel the bail bond of the petitioner if he involves in some serious
nature of offence or defaults on two consecutive occasions.
