The petitioner is languishing in custody since 1 7.10.2013 in a case registered for the offences punishable u nder Sections 272, 273, 120B, 290 of the Indian Penal Code a nd 47(a) of the Excise Act.
Accusation is of selling liquor from a licensee shop on a dry day.
It is submitted by learned counsel for the petitioner that from the accusation it does not reflect that which brand of liquor was sold to whom. Moreover, the police has no authority to lodge such type of cases.
A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
