The petitioner is languishing in custody since 0 9.08.2013 in a case registered for the offences punishable u nder Sections 461, 379/411 of the Indian Penal Code and 25(1- b ), 26 and 35 of the Arms Act.
The accusation is of making attempt to commit theft in the ATM machine of Axis Bank at N.H. 31. The petitioner and Sujay Kumar were apprehended with some incriminating weapons, mobile phone and one cartridge.
It is submitted by learned counsel for the petitioner that even assuming the accusation the case under Section 379 of the IPC is not made out and the petitioner has never been made accused in any similar nature of offence, though he is accused in one other case registered under Section 420 of the IPC.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Barh, District - Patna in connection with Barh P.S. Case No. 220 of 2013.
