The petitioner apprehends his arrest for the offence punishable under Sections 498A, 324, 307 of the I.P.C. and Sections ¾ of Dowry Prohibition Act.

The allegation against the petitioner and others is to have assaulted the informant for demand of dowry.

It is submitted that since the informant did not come to

the house of the petitioner, he filed a petition under Section 9 of Hindu Marriage Act for the restitution of conjugal rights. The Matrimonial Case No.41 of 2014 was filed on 18.02.2014 against the informant and her father and after few days on 22.02.2014, the informant has lodged this case. The petitioner is ready to lead conjugal life with the informant, but the informant does not want to lead conjugal life with the petitioner. The petitioner has no criminal antecedent.

Considering the facts and circumstances of the case, let the petitioner above-named be released on bail in the event of arrest or surrender within a period of one month on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Pupri at Sitamarhi in Bajpatti P.S. Case No. 34/2014 subject to the condition as laid down under Section 438 (2) of the Code of

One of the bailors will be the close relative of the petitioner.

The petitioner will not indulge in similar or in any other offence.
