The petitioners apprehend their arrest in a case

registered for the offence punishable under Sections 406/420/34 of IPC.

Allegation is that petitioner no. 1 agreed with the

complainant for sale of land for a consideration of Rs.60,000/- out of which Rs.40,000/- was paid to him. The date of registration of sale deed was extended on the ground that the land stands in the name of his son and he is out of station. His son, petitioner no. 2 returned to his house, even

thereafter the sale deed was not executed. Thus, the petitioners have usurped Rs.40,000/- of the informant.

It is submitted that the petitioners have been falsely implicated in this case due to land dispute. No money has been taken by the petitioner no. 1 from the complainant/informant. The petitioners have no criminal antecedent.

Considering the facts and circumstances, in case of arrest or surrender within a period of four weeks the above named petitioners will be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand only) each with two sureties of the like amount each to the satisfaction of learned SDJM, Raxaul at Motihari, East Champaran in Chhauradano P. S. Case No. 01 of 2013, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure and the other following conditions:-

The petitioners will not indulge themselves in similar or any other offence.

One of the bailors must be the close relative of the petitioners.

The petitioners will be well represented in the Court on each and every date and in case of absence for two
