It is contended that the specific allegation of assault by ‘Samath’ (a hard and blunt object) upon head of deceased Ramashray Paswan is against co-accused Lokendra Paswan. There is general and omnibus allegation against five others to have assaulted the deceased. It has further been contended that in the post mortem report, the cause of death has been assigned to be the head injury caused by co-accused Lokendra Paswan.
Learned counsel for the petitioner Mr. Bikram Dev Singh submitted that three other co-accused persons having identical allegations namely Vijendra Paswan, Sikandra Paswan and Kesar Paswan have already been granted bail by order dated 10.01.2014 passed in Cr. Misc. Case no.26662 of 2013.

Considering the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Sheikhpura in connection with Sheikhpura Sarai P. S. Case No.11 of 2013.
