While the informant Shanti Devi along with her husband, brother in-law, Gotni and others was gossiping, at that very moment, the accused persons so named including the petitioner came, abused and during course thereof, petitioner along with Rupesh Jha gave knife blow over head of Govind Jha as well as Sobind Jha. Rupesh Jha gave ‘lathi’ blow on account of which her husband Govind Jha sustained fracture of hand. Informant was assaulted by Mundrika Devi, Anju Kumari, Anshu Kumari. The accused persons also ransacked the house and during course thereof, Rajesh Jha had snatched away Mangal-sutra from her Gotni Anita Devi.

and 42 of the case diary wherefrom omnibus allegation happens to be. Apart from paras-26 and 27, the injury report of respective injured suggesting sustaining of incised wound on right parietal temporal region 4cm x 1cm x 1/ 2cm. Incised wound at left external ear 1½ cm x 1/ 2cm x 1/ 2cm. Incised wound mid forehead 1cm x 1/ 2cm x 1/ 2cm all simple in nature as well as incised wound over left temporal region 1cm x 1/2cm x 1/2cm. Incised wound left scalp back 2cm x 1/2cm x 1/2cm. Abrasion 1cm x 1/2cm at left ear all simple and tenderedness left lower arm, suggesting compound fracture grievous in nature over respective injured and for that petitioner happens to be under custody since 21.02.2014.

On the other hand, learned Additional Public Prosecutor opposed the prayer.

Accordingly, petitioner Rajesh Jha is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Bathnaha P. S. Case No.30 of 2014.
