Five motorcycle borne people out of whom informant had claimed identification of petitioner along with Niraj Kumar and Ayodhya Yadav kidnapped her daughter Pushpa Kumari aged about 13 years while she along with others including the informant, mother had gone to meet natures call.

Case diary up to dated 09.06.2014 is available and from perusal of the same it is evident that the witnesses examined till then have supported the prosecution case however had given some indication that during course of examination of Inter, Pushpa and her friend Nitu had stayed at

the house of Niraj and during course thereof, some sort of intimacy developed whereupon both were in contact over mobile. By way of supplementary affidavit statement of victim recorded under Section 164 Cr.P.C. has been filed where from it is evident that apart from claiming herself to be major, the alleged victim dethrone the prosecution version with regard to kidnapping and contrary to it stated that she on her own gone along with Niraj as well as she married.

In the aforesaid background petitioner, Tarachand Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Sri S.K. Rai, Judicial Magistrate, 1^st Class, Jehanabad / successor in office in connection with Shakurabad P.S. Case No.39 of 2014 .
