The petitioner seeks bail in Khagaria (Mufassil) P.S. Case No. 662 of 2012 dated 22.12.2012 instituted under Sections 307 / 324 / 34 of the Indian Penal Code and Section 27 of the Arms Act.

Learned counsel for the petitioner submits that though there is an allegation of firing by the petitioner which has hit the buttock of the informant, but during investigation, the wife of the informant has stated that there was firing between two groups due to fishing dispute, which has resulted in such incident. It is further stated that the petitioner is in custody since

Learned A.P.P., upon going through the case diary, as well as the learned counsel for the informant submit that the informant has named the petitioner as the person, who has hit him on the buttock, and the injury report also shows that the bullet entered through the buttock and came out through the thigh and that he has got fracture of right upper end of Femur and Neck, and the injury has been found to be grievous. It is further stated that the petitioner has criminal antecedent and is accused in six cases.

Considering the facts and circumstances of the case and submissions of learned counsels for the parties, the Court is not inclined to enlarge the petitioner on bail. Accordingly, the application stands dismissed.

However, the court below shall expedite the trial and conclude the same within six months.
