4 18-07-2014 Heard learned counsel for the petitioner and learned A.P.P. for the State.
The petitioner seeks bail in Jamalpur Rail P.S. Case No. 33 of 2013 dated 27.10.2013 instituted under Sections 25(1) (a)(b) (1-AA) (1-B) (e) / 26 / 35 of the Arms Act.
Learned counsel for the petitioner submits that there is recovery of three pistols, three magazines, cartridges and mobile as well as Rs. 9,000/-, but the petitioner is innocent as he has no connection with the bag from which the above articles have been recovered. It is further submitted that the petitioner has clean antecedent and he is in jail since 29.10.2013.
Considering the facts and circumstances of the case and submissions of learned counsels for the parties, let the petitioner be released on bail on furnishing bail bonds of Rs.

10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Kiul, District - Lakhisarai in Jamalpur Rail P.S. Case No. 33 of 2013. The petitioner and the bailors shall execute bond with regard to good behaviour of the petitioner. The petitioner shall give an undertaking to the Court that he shall not indulge in any criminal activity. Any violation of the terms and conditions of the bonds or the undertaking shall lead to cancellation of his bail bonds. The petitioner shall cooperate in the trial and be present before the Court on each and every date. Failure to do so on two consecutive dates, without sufficient cause, shall also lead to cancellation of his bail bonds.
