3. 18.07.2014 Heard learned counsel for the petitioners and learned A.P.P. for the State.

The petitioners seek bail in Chandauti P.S. Case No. 288 of 2013 dated 19.08.2013 instituted under Sections 302/201/34 of the Indian Penal Code.

Learned counsel for the petitioners submits that they are among 13 named persons but the allegation is general and omnibus assault by ‘Lathi’ ‘Danda’ and ‘Bricks’ without there being any specific allegation of any particular assault. It is submitted that a similarly situated co-accused namely, Laxman Manjhi, has been granted bail by a coordinate Bench of this Court on 05.03.2014 in Cr. Misc. No. 2914 of 2014. It is further submitted that the petitioners have clean antecedent and are in custody since 24.09.2013.

diary, does not dispute the fact that the allegation against the petitioners is general and omnibus and also that during investigation, no specific allegation has been made against them.

Considering the facts and circumstances of the case and submissions of learned counsels for the parties, let the petitioners be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Gaya in Chandauti P.S. Case No. 288 of 2013. The petitioners shall cooperate in the trial and be present before the Court on each and every date. Failure to do so on two consecutive dates, without sufficient cause, shall lead to cancellation of their bail bonds.
