JUSTICE AHSANUDDIN AMANULLAH ORAL ORDER 5. 18.07.2014 Heard learned counsel for the petitioner and learned A.P.P. for the State. The petitioner seeks bail in Sahebganj P.S. Case No. 93 of 2013 dated 28.04.2013 instituted under Sections 353/307/120B of the Indian Penal Code. Learned counsel for the petitioner submits that even in the F.I.R., the only allegation is that the incident had occurred at the instance of the petitioner. It is submitted that nothing has been recovered from the petitioner and that there are no witnesses to the effect that the petitioner was also present at the time of occurrence. It is submitted that another co-accused namely, Raj Kumar Rai, against whom also during investigation it has come that at his instance the incident had occurred, has been granted bail by a co-ordinate Bench of this Court in Cr.
