Petitioner is accused in connection with Deo P.S. Case No. 71 of 2013 registered under Sections 272, 420 of the I.P.C. and 47(A) of the Excise Act.
The accusation is that Police on raid recovered 600 pouches each containing 400 ml. and 1378 pouches each containing 200 ml. of country-made liquor in the newly constructed house of the petitioner but he did not give satisfactory reply and said that the alleged liquor was stored by one Kamlesh Pawan, who is tenant.
Learned counsel appearing on behalf of the petitioner submits that it would appear from the F.I.R. that the petitioner was not found in the house at the time of search, rather the house was taken by one Kamlesh Paswan on rent. It is also submitted that petitioner has no criminal antecedent and is n
