The petitioner seeks bail in connection with Gardanibag P.S. Case No.436 of 2013 registered under Sections 498-A, 494 and 120-B of the Indian Penal Code.

The allegation against the petitioner is of torturing the informant, Sanju Devi, who is his wife, for demand of dowry regarding which Gardanibag P.S. Case No.197 of 2011 under Sections 323, 307 and 498-A of the Indian Penal Code besides Sections 3/4 of the Dowry Prohibition Act was instituted against the petitioner, which is pending for disposal. In spite of efforts for reconciliation in that case, the petitioner did not take his wife to her sasural and one occasion, the petitioner left his wife in the way in course of carrying to her sasural. informant also came to know that there is one child due to that wedlock.

Learned counsel appearing on behalf of the petitioner submits that, in fact, torturing the informant by the petitioner for demand of dowry is baseless as the petitioner has purchased the land in the name of his wife/informant. It is further submitted that as the informant does not want to live with the petitioner, the informant has lodged this false case. The petitioner is in custody since 8.1.2014.

Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Amit Raj, Judicial Magistrate, First Class, Patna, in connection with Gardanibag P.S. Case No.436 of 2013.
