Petitioner is accused in connection with Atri P.S. Case No. 35 of 2005 registered under Sections 147, 148, 149, 341, 323, 302, 379 and 325 of the I.P.C.
The accusation is that the petitioner along with Devsaran Yadav, Ram Saran Prasad Yadav, Indal Yadav and Karu Yadav and others came armed with weapons and stopped the informant and his brother Reyajudeen Kuraisi and on the order of Devsaran Yadav and Ram Saran Prasad Yadav to kill and snatch money then all caused injury to his brother through lathi, iron rod and butt of the pistol. At that time, Karu Yadav caused the blood oozing injury at the head of Reyajudeen Kuraisi by butt, who died later on.

petitioner submits that there is general and omnibus allegation against the petitioner and others with specific allegation against Karu Yadav to cause injury through butt of the pistol on the forehead of the deceased. It is further submitted that similarly situated co-accused Indal Yadav has already been allowed bail by a Bench of this Court vide Cr. Misc. No. 19307 of 2013. Petitioner is in custody since 05.02.2014, having no criminal antecedent.
Under the facts and circumstances of the case, the petitioner is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of C.J.M., Gaya in connection with Atri P.S. Case No. 35 of 2005.
