JUSTICE DINESH KUMAR SINGH ORAL ORDER 03/ 10-07-2013 Heard learned counsels for the petitioner and the State. The petitioner has renewed his prayer for bail in a case registered for the offence punishable under Section 302 of the Indian Penal Code and he is languishing in custody since 30.12.2009.

It is alleged against the petitioner that he strangulated

his wife.

The petitioner was given liberty to renew his prayer for bail, if the trial is not concluded is not concluded within a period of one year. The report of the learned court below kept at Flag ‘A’ dated 14.06.2013 suggests that not a single witness has been examined but it is submitted by learned counsel for the petitioner that till 17.06.2013 to 02.07.2013 four witnesses have been examined when the report of the learned court below further suggests that the trial will be concluded within six months.

On this ground, this Court is not inclined to interfere.

Accordingly, this application is disposed of.

However, the petitioner will be at liberty to renew his prayer for bail, if the trial is not concluded within six months.

Let the order be transmitted to the court of learned Additional Sessions Judge, IV, Gaya in connection with Sessions Trial No. 208 of 2011/426 of 2010 arising out of Dumariya P.S. Case No. 67 of 2009 through FAX at the cost of the petitioner.
