JUSTICE DINESH KUMAR SINGH ORAL ORDER 3 05-04-2013 Heard learned counsels for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 323, 341, 452, 504, 506/34 of the Indian Penal Code, 3(1)(v) and (x) of the SC/ST (Prevention of Atrocities Act). It is alleged that the petitioner alongwith thirty persons were laying foundation on the land of the informant when the informant objected, the accused persons assaulted the informant. It is submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. Moreover, a proceeding under Section 145 Cr. P.C. is going on with regard to the same land and on accusation made, no offence under SC/ST Act is made out. The name of the petitioner subsequently sprang up and there is specific accusation against F.I.R. named accused persons.

Considering the aforesaid facts, let the
petitioner, above named, be released on bail in the
event of arrest or surrender before the learned
court below within a period of twelve weeks from
today in connection with Alauli P.S. Case No. 28 of
2012(G.R. No. 242 of 2012) on furnishing bail bond
of Rs.10,000/-(Ten Thousand) with two sureties of
the like amount each to the satisfaction of the
learned C.J.M. Khagaria, subject to the conditions
as laid down under Section 438(2) of the Code of
Criminal Procedure.
