Heard learned counsels for the petitioner and
the State.
The petitioner no. 1 is apprehending her arrest in a case registered for the offences punishable under Sections 467, 468, 471, 406 and 420/34 of the Indian Penal Code.
The accusation is of taking loan of Rs. Ten lakhs by the petitioner. The petitioner denies the taking of the loan when the case of the bank is that the loan amount was given to M/s. Raj and Raj Enterprises the supplier of the flour mill at the behest of the petitioner.
It is orally submitted by learned counsel for

the bank that the recovery proceeding is going on.
A statement has been made in para 23 that
the petitioner has no criminal antecedent.
Considering the nature of accusation, let the above named petitioner no.1 be released on anticipatory bail in the event of her arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Khagaria in connection with Khagaria P.S. Case No. 319 of 2011, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
The grant of bail will not preclude the bank to recover the amount involved in the present case.
