JUSTICE DINESH KUMAR SINGH ORAL ORDER 2 03-01-2013 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 395 of the I.P.C. Accusations are of committing robbery by blocking the road and when the police reached there and fired then one of the miscreants injured but others managed to flee away.

It is submitted by learned counsel for the petitioners that petitioners were not named in the F.I.R. and their names sprang up during the investigation when a statement has been made in para 12 of the petition that petitioners have no criminal antecedent. It is further submitted that other co-accused has been granted regular bail by this Court vide Cr. Misc. No. 5349 of 2012.

This Court sees no reason for learned Court below not to consider the regular bail of the petitioners, if the petitioners surrender within a period of six weeks in connection with Wazirganj P.S. Case No. 82 of 2009, pending in the Court of learned Chief Judicial Magistrate, Gaya.

With the observations above, the application stands disposed off.
