JUSTICE DINESH KUMAR SINGH ORAL ORDER 03/ 04-01-2013 Heard learned counsels for the petitioner and the State. The petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

The police officer located a dead body in the field when the FIR was lodged against unknown and after five months of the occurrence the name of the petitioner sprang up when the brother of the victim identified the clothes and raised suspicion since the petitioner took some loan from the deceased earlier.

It is submitted by learned counsel for the petitioner that the victim was a veteran criminal when this petitioner lodged Kazi Mohammadpur P.S. Case No. 178 of 2011 on 18.07.2011. It is further submitted that

the petitioner was an accused in one case earlier lodged in which final form was submitted.

Considering the fact that the suspicion has been raised against the petitioner after several months of the occurrence, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Muzaffarpur in connection with Saraiya P.S. Case No. 407 of 2011, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
