2 04-01-2013 Heard learned counsels for the petitioners and the State. The petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 148, 149, 323, 448, 427, 380, 452 and 504 of the Indian Penal Code. The accusation is of entering into the house of the informant and committing theft. It is submitted by learned counsel for the petitioners that F.I.R. was lodged four days after

occurrence when during investigation accusation was
found false and final form was submitted but
differing with the same cognizance has been taken
against the petitioners when the informant is an
accused in a murder case registered under Sections
307, 302, 120B of the Indian Penal Code and 27 of
the Arms Act lodged by the petitioners’ side.

Considering the aforesaid facts, let the
petitioners, above named, be released on bail in the
event of arrest or surrender before the learned
court below within a period of twelve weeks from
today in connection with Bhabua P.S. Case No. 70 of
2011, Tr. No. 2456 of 2012 on furnishing bail bond
of Rs.10,000/-(Ten Thousand) each with two sureties
of the like amount each to the satisfaction of the
learned J.M.Ist Class, Kaimur (Bhabua), subject to
the conditions as laid down under Section 438(2) of
the Code of Criminal Procedure.
